PARTICIPANT AGREEMENT, RELEASE AND ASSUMPTION OF RISK
In consideration of the services of Minervo, Inc., D.B.A. Rage Ground, their agents, owners, officers, managers, volunteers, participants, employees, and all other persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as "RG"), I hereby agree to release, indemnify, and discharge RG, on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative and estate as follows:
1. I acknowledge that my participation in RG Room activities entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity.
The risks include, among other things: slipping and falling; confined spaces; flying debris from broken objects; sharp edges and broken glass; physical exertion; interaction with other participants; the negligence of other participants; and other risks inherent to the activity. I also acknowledge that there may be other risks not known to me or not reasonably foreseeable at this time.
2. I expressly agree and promise to accept and assume all of the risks existing in this activity. My participation in this activity is purely voluntary, and I elect to participate in spite of the risks.
3. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless RG from any and all claims, demands, or causes of action, which are in any way connected with my participation in this activity or my use of RG's equipment or facilities, including any such claims which allege negligent acts or omissions of RG.
4. Should RG or anyone acting on their behalf, be required to incur attorney's fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.
5. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have.
6. In the event that I file a lawsuit against RG, I agree to do so solely in the state of California, and I further agree that the substantive law of that state shall apply in that action without regard to the conflict of law rules of that state. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining document shall continue in full force and effect.
By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against RG on the basis of any claim from which I have released them herein.
I have had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms.
Terms & Conditions
We may refuse service to anyone under the influence of alcohol or drugs. Participants must be 10+ years old, and those under 15 require supervision. Non-compliant participants may be asked to leave without refunds. Participants consent to be photographed and filmed. All must wear provided protective gear. Outside gear/weapons are subject to staff approval.
BYOB Rules
Free BYOB (Bring Your Own Box) for up to 10lbs, anything exceeding is $2/lb. There are some restrictions as to what can be brought in. We do not allow the following: Electronics of any kind, appliances, light bulbs, batteries, paint, consumables, liquids, weapons, or anything of the like.
ID Verification
Person whose name is on the reservation must provide a valid ID that matches. A photo of the ID will be taken for security and record-keeping purposes. If ID is not provided you will not be permitted to participate and no refund will be given. Everyone must arrive with closed-toed shoes (no heels, crocs, sandals, etc.). Service may be refused to those without appropriate footwear.
Cancellations/Refunds and Rescheduling Policy for Regular Bookings
Cancellations are not permitted within 36 hours of the scheduled appointment and are not eligible for a refund. Rescheduling within 36 hours may be allowed based on availability and will incur a $35 rescheduling fee.
Cancellations/Refunds and Rescheduling Policy for Private Events
For cancellations, party size adjustments, and date changes, a full 7 days' notice is required. Cancellations within this 7-day period will result in forfeiture of the deposit.
Late Policy
Arrivals more than 10 minutes late may lose their reservation and be asked to reschedule or be considered a walk-in. Room availability is not guaranteed for late parties.
Damage Fee
Participants must adhere to our rules. Any property damage will be charged to the card on file. Broken doors are subject to a $300 replacement fee per door. All other damages are assessed at the facility based on the actual cost of repair, which may vary depending on the extent of damage, labor, and materials.
